On April 21, 2004, pursuant to Standing Order 108 (1), the Standing Committee on Agriculture and Agri-Food adopted the following motions:

 

 

Le 21 avril 2004, conformément à l’article 108 (1) du Règlement, le Comité permanent de l’agriculture et de l’agroalimentaire a adopté la motion suivante :

 

 

That a letter be sent to Cargill Foods, Lakeside Packers Ltd., Levinoff Meat Products Ltd. and Better Beef Limited, stating that this Committee is aware that certain information provided by the aforementioned companies, may contain sensitive business information, therefore the Clerk of the Committee is directed to not provide copies of the information received to Members of the Committee.  The Clerk is directed to provide the information to the Office of the Law Clerk and such individual(s) that may be engaged by the Library of Parliament for the purpose of reviewing the information received and preparing a report to this Committee, such report to be prepared in such a fashion as to protect specific sensitive business information that may disclose the identity of any person or corporation providing such information;

 

 

 

 

Qu’une lettre soit envoyée à Cargill Foods, Lakeside Packers Ltd., Levinoff Meat Products Ltd. et Better Beef Limited, affirmant que le Comité sachant que certaines informations fournies par ces compagnies sont peut-être de nature commerciale délicate et que par conséquent le greffier soit ordonné de ne pas en faire de copies pour les membres du Comité. Que le greffier transmette l’information au Bureau du légiste ainsi qu'à toute personne chargée par la Bibliothèque du Parlement d'en faire l'examen et de préparer un rapport à l'intention du Comité, ce rapport devant être rédigé de façon à protéger les informations commerciales délicates pouvant révéler l’identité d’une personne ou d’une entreprise.

That these companies produce the previously requested documents (see attached letter) no later than April 30, 2004;

 

 

Que ces compagnies produisent les documents demandés (voir pièce jointe) d’ici le 30 avril 2004.

 

 

That the Chair of the Committee retain the services of the required number of relevant experts from the Library of Parliament, in order to review and report to the Committee or newly reconstituted Committee, any findings as a result of the required documents being supplied to the Committee by April 30, 2004;

 

 

Que le président du Comité retienne les services du nombre d’experts pertinents nécessaire de la Bibliothèque du Parlement, pour l’étude des documents reçus d’ici le 30 avril et pour faire rapport au Comité ou à son successeur.

 

That the documents provided to the Clerk in accordance with the motions dated March 29 and April 21, 2004 be retained by the Clerk’s office for such time as they may be required by the Committee or its successor, and thereafter be destroyed.  In the event that the report required by the motion of April 21, 2004 is not made to the Committee during this Parliament, the documents are to be retained by the Clerk to be dealt with in such manner as may be directed by the successor Committee established by the 38th Parliament.  If the Clerk receives no such direction within 30 days of the establishment of the successor Committee, the documents provided to the Clerk in accordance with the motions dated March 29 and April 21, 2004 shall be destroyed; and 

 

 

Que les documents fournis au greffier conformément aux motions du 29 mars et du 21 avril 2004 soient conservés à son bureau pour l’usage du Comité ou de son successeur, puis détruits. Si le rapport requis par la motion du 21 avril n’est pas produit durant la législature en cours, les documents seront conservés par le greffier et utilisés selon les instructions du Comité successeur créé par la 38e législature. Si le greffier ne reçoit pas d’instructions à ce sujet dans les trente jours de la création du nouveau Comité, les documents en question seront détruits.

 

That if these companies fail to produce the said documents, the matter will be reported to the House.

 

 

 

Si les compagnies susmentionnées omettent de produire les documents réclamés, l’affaire sera rapportée à la Chambre.

Que Lakeside Packers Ltd., de Brooks en Alberta, Cargill Foods de High River, en Alberta, et XL Beef de Calgary, en Alberta et en Saskatchewan, Better Beef Limited, Ontario et Produits de viande Levinoff limitée, Québec, soient tenus de fournir au greffier du Comité, avant le 21 avril 2004, pour examen à huis clos par le Comité permanent, les documents suivants :

 

(a) a copy of the financial statements detailing the added marginal costs attributable to the new BSE safety regulations along with their profit margins on a monthly basis for calendar year 2003; and

 

 

(a) une copie des états financiers où sont détaillés les coûts marginaux supplémentaires attribuables au nouveau règlement en matière de salubrité (ESB) ainsi que leurs marges de profit, sur une base mensuelle, pour l’année civile 2003 ;

 

(b) documents explaining why the prices they paid for fed steers and heifers declined by approximately 50% in the three weeks following announcement of the federal-provincial BSE Recovery Program on 18 June 2003.
