SECOND REPORT	DEUXIÈME RAPPORT
Pursuant to Standing Order 108(2), your Committee has considered a motion in the name of the member for Ottawa South (David McGuinty) and has agreed to report the following:	Conformément au paragraphe 108(2) du Règlement, le Comité a examiné une motion présentée au nom du député de Ottawa-Sud (David McGuinty) et a convenu de faire rapport de ce qui suit :
That this committee call upon the government to bring forward legislation to strengthen the role of the Commissioner of the Environment and Sustainable Development by:	Que le comité presse le gouvernement de présenter un projet de loi visant à renforcer les pouvoirs du commissaire à l’environnement et au développement durable :
making the Commissioner a full and independent Agent of Parliament (“Office of the Commissioner of the Environment and Sustainable Development”) reporting to Parliament directly through the Speakers of both the House of Commons and the Senate;	en faisant du commissaire un agent du Parlement, totalement indépendant (« Bureau du commissaire à l’environnement et au développement durable ») et rendant directement des comptes au Parlement par le biais des présidents respectifs de la Chambre des communes et du Sénat;
clearly affirming and appropriately circumscribing the duty of the Office of the Commissioner to advocate on environmental and sustainable development issues;	en établissant clairement et en définissant comme il convient la mission du Bureau du commissaire, qui se fait défenseur des questions relatives à l’environnement et au développement durable;
requiring that the appointment of a Commissioner be approved by both the House and the Senate;	en exigeant que la nomination du commissaire soit approuvée par la Chambre des communes et par le Sénat;
ensuring that a funding mechanism at arm’s length from the government be established for the Office of the Commissioner; and	en s’assurant qu’un mécanisme de financement indépendant du gouvernement soit établi pour le Bureau du commissaire; et
protecting the right of the Commissioner to name the Office’s staff, including environmental auditors, without government influence.	en préservant le droit du commissaire à sélectionner le personnel de son bureau, y compris les vérificateurs environnementaux, sans ingérence du gouvernement.
And that the Committee adopt these recommendations as a report to the House and that the Chair present this Report to the House.	Et que le Comité adopte ces recommandations comme rapport à la Chambre et que la présidence présente ce rapport à la Chambre.

SUPPLEMENTARY OPINION	OPINION COMPLÉMENTAIRE
Conservative Members of the House of Commons Standing Committee on Environment and Sustainable Development have the honour to present a supplementary report regarding the motion passed by the committee on February 26, 2007.	Les membres conservateurs du Comité permanent de l’environnement et du développement durable de la Chambre des communes ont l’honneur de présenter un rapport complémentaire concernant la motion adoptée par le Comité le 26 février 2007.
Conservative members note that the Liberal party, in its 1993 election campaign document (known as the Red Book), made the following commitment:	Les membres conservateurs font remarquer que le Parti libéral, dans son document de la campagne électorale de 1993 (intitulé le Livre rouge), a fait la promesse suivante :
“Our second task will be to appoint an Environmental Auditor General, reporting directly to Parliament, with powers of investigation similar to the powers of the Auditor General.” (1993 Liberal Red Book, page 64)	Ensuite, un gouvernement libéral désignera un commissaire à l'environnement qui sera comptable envers le Parlement et disposera de pouvoirs semblables à ceux du vérificateur général. (Livre rouge libéral de 1993, p. 60)
Sadly, for thirteen years, the Liberal party did nothing to create such an independent office. And for another year in opposition, the Liberal party still did nothing to advance this issue. They decided to play politics with the issue only after it became a headline in the media.	Malheureusement, en treize ans, le Parti libéral n’a rien fait pour créer un tel bureau indépendant. Et, pendant une autre année dans l’opposition, il n’a toujours rien fait pour faire avancer ce dossier. Il a décidé de faire de la politicaillerie sur cette question, uniquement lorsque celle-ci a fait les manchettes des médias.
Our second concern arose from the poorly written motion presented by the Liberal party. For example, we are concerned about the use of the term “advocacy” in the text of the motion. The Auditor General, in her testimony also raised serious concerns, stating:	Notre deuxième point a trait au piètre texte de la motion présenté par le Parti libéral. Ainsi, nous avons des réserves concernant l’emploi de l’expression défense de causes dans le texte de la motion. Dans son témoignage, la vérificatrice générale a aussi formulé d’importantes réserves, affirmant :
“policy advocacy and legislative audit are incompatible. This is a recognized principle in the auditing profession, and it is based on the standard that governs all auditors in Canada.” (Meeting No. 41:1115)	[…] la défense de causes et la vérification législative sont incompatibles. C’est un principe reconnu en vérification et il repose sur une norme que tous les vérificateurs au Canada doivent respecter. (Réunion 41:1115)
Government members also wish to condemn the Member for Ottawa South, Mr. David McGuinty, for attempting to mislead Canadians. Mr. McGuinty was quoted in relation to Ms. Gélinas’ situation as saying: “Political interference cannot be ruled out” (Canadian Press, February 27, 2007).	Les membres du gouvernement reprochent également au député d’Ottawa Sud, M. David McGuinty, d’voir tenté d’induire les Canadiens en erreur. Concernant la situation de Mme Gélinas, M. McGuinty aurait affirmé qu’une ingérence politique n’était à exclure (Presse canadienne, 27 février 2007).
This is in direct conflict with what Ms. Gélinas herself has said when she explicitly stated that “the discussions (between the Auditor General and Ms. Gélinas) were in private with no interference whatsoever from the Government of Canada and its representatives.” (Johanne Gélinas statement, January 30, 2007). We believe that Mr. McGuinty should retract those comments immediately as they are not consistent with the facts.	Cela contredit directement les propos de Mme Gélinas quand elle a déclaré que les discussions (entre la vérificatrice générale et elle) ont eu lieu en privé sans aucune ingérence du gouvernement du Canada et de ses représentants (Déclaration de Johanne Gélinas, 30 janvier 2007). Nous estimons que M. McGuinty devrait immédiatement se rétracter car ses propos ne correspondent pas aux faits.
In closing, Conservative members on the committee are not convinced that the motion introduced by the Liberal party is in the best interests of Canadians, largely because of the breadth of the terms of the motion.	Enfin, les membres conservateurs du Comité ne sont pas convaincus que la motion présentée par le Parti libéral est dans le meilleur intérêt des Canadiens, essentiellement à cause de la portée du texte de la motion.
At the same time, we believe the issue requires further in-depth study, which is why Conservative members abstained from the vote. We note that the Auditor General of Canada in her testimony before this committee on February 8, 2007, indicates that a serious review of the role and responsibilities of the Commissioner of the Environment and Sustainable Development will take place and we are encouraged by that development.	Par ailleurs, nous pensons qu’il faut approfondir l’étude de la question, et c’est pourquoi les membres conservateurs se sont abstenus de voter. Nous signalons que, dans son témoignage du 8 février 2007 devant le Comité, la vérificatrice générale du Canada a indiqué que le rôle et les responsabilités du commissaire à l’environnement et au développement durable seront examinés en détail, ce que nous trouvons encourageant.
