(2) Section 2 of the Act is amended by adding the following in alphabetical order: “boundary waters” has the same meaning as in the Preliminary Article of the treaty relating to the boundary waters and to questions arising along the boundary between Canada and the United States signed at Washington on January 11, 1909 and set out in Schedule 1 to the International Boundary Waters Treaty Act. “transboundary waters” has the same meaning as in section 10 of the International Boundary Waters Treaty Act. | (2) L’article 2 de la même loi est modifié par adjonction, selon l’ordre alphabétique, de ce qui suit : « eaux limitrophes » S’entend au sens de l’article préliminaire du traité relatif aux eaux limitrophes et aux questions survenant le long de la frontière entre le Canada et les États-Unis, signé à Washington le 11 janvier 1909 et reproduit à l’annexe 1 de la Loi du traité des eaux limitrophes internationales. « eaux transfrontalières » S’entend au sens de l’article 10 de la Loi du traité des eaux limitrophes internationales. |

4.1 (1) The purpose of this section is to prevent the risk of environmental harm resulting from the permanent loss of water from Canadian ecosystems. (2) No licence may be issued for the construction, operation or maintenance of an international river improvement that links waters that are neither boundary waters nor transboundary waters to an international river if the purpose or effect of the improvement is to increase the annual flow of the international river at the international boundary. | 4.1 (1) Le présent article a pour objet la prévention des risques de dommages environnementaux qui découlent des pertes d’eau permanentes dans les écosystèmes canadiens. (2) Il ne peut être délivré de permis pour la construction, la mise en service ou l’entretien d’ouvrages destinés à l’amélioration d’un cours d’eau international si l’ouvrage relie à ce cours d’eau des eaux qui ne sont ni des eaux limitrophes ni des eaux transfrontalières et a pour objet ou pour effet d’augmenter le débit annuel de celui-ci à la frontière internationale. |
