Background

During debate on the motion to adjourn the House to study the merits of a recent federal-provincial conference on the Constitution under the terms of a special order adopted the previous day, Mr. Fortin (Lotbinière), who had been recognized on a point of order, proposed a motion to extend the debate one hour beyond the regular 5:00 p.m. hour of adjournment. The Acting Speaker (Mr. Bechard) ruled immediately.

Issue

Can a motion not to adjourn the House at the ordinary hour be proposed by a Member who was recognized on a point of order?

Decision

No, a Member cannot propose such a motion on a point of order.

Reasons given by the Speaker

The Member was recognized on a point of order. "... it is out of order to move a motion of this kind at this stage."
