Meeting No. 97

Wednesday, May 12, 1999

The Standing Committee on Canadian Heritage met at 3:45 p.m. this day, in Room 536, Wellington Building, the Vice-Chair, Ted McWhinney, presiding.

Member of the Committee present: Mauril Bélanger, Paul Bonwick, Sarmite Bulte, Maurice Dumas, John Godfrey, Joe Jordan, Eric Lowther, Inky Mark, Mark Muise and Caroline St-Hilaire.

Acting Members present: Derrek Konrad for Jim Pankiw; Pat O'Brien for Joe Jordan; Denis Paradis for Dennis Mills; Hec Cloutier for Raymond Lavigne.

In attendance: From the Library of Parliament: Joe Jackson.

Witnesses: From the Department of Canadian Heritage: David Walden, Director, Moveable Cultural Property, Arts and Heritage. From the Department of Justice: Bruce Stockfish, Legal Counsel.

Pursuant to the Order of Reference of the House dated Friday, April 23, 1999, a study of Bill C-64, An Act to establish an indemnification program for travelling exhibitions.

The Committee proceeded to Clause-by-Clause consideration of the Bill.

Clause 1 was postponed, pursuant to Standing Order 75(1).

On Clause 2

Caroline St-Hilaire moved,-- That Clause 2, be amended by striking out, in the French version only, lines 16 and 17, on page 1, and substituting with the following therefore:

"objets de l'exposition qui sont empruntés à l'étranger dépasse celle des objets empruntés au"

After debate, the question being put on the amendment, it was negatived.

Mauril Bélanger moved,--That Clause 2, be amended by striking out, in the French version only, line 16 on page 1, and substituting with the following therefore:

"objets qui en font partie et qui sont empruntés à l'étranger"

After debate, the question being put on the amendment, it was agreed to on division.

Clause 2, as amended, carried on division.

On Clause 3

Caroline St-Hilaire moved,-- That Bill C-64, in Clause 3, be amended by striking out line 28 on page 2, and substituting with the following therefore:

"other Act of Parliament, at any time"

After debate, the question being put on the amendment, it was negatived.

Clause 3 carried on division.

Clause 4 carried on division.

On Clause 5

Caroline St-Hilaire moved,-- That Bill C-64, in Clause 5, be amended by deleting lines 5 and 6, on page 3.

After debate, the question being put on the amendment, it was negatived.

Clause 5 carried on division.

New Clause 5.1

Mauril Bélanger moved,--That Bill C-64, be amended by adding after line 25 on page 3, the following therefor:

"5.1 (1) The administration of this Act shall, five years after the coming into force of this Act, be reviewed by the committee of the House of Commons, that may be designated or established by Parliament for that purpose.

(2) The committee designated or established by Parliament for the purpose of subsection (1) shall undertake a review of the provisions and operation of this Act and shall, within a year after the review is undertaken or within any further time that the House of Commons may authorize, submit a report to Parliament thereon including a statement of any changes to this Act or its administration that the committee would recommend."

After debate, the question being put on the amendment, it was agreed to on division.

New Clause 5.1 carried.

Clause 6 carried on division.

Clause 1 carried on division.

The Title carried.

The Bill carried.

ORDERED,--That Bill C-64 be reported with amendments to the House.

ORDERED,--That the Committee order a reprint of the bill for the use at Report Stage.

Pursuant to Standing Order 108(2), the Committee proceeded, at 4:20 p.m., to consider the topic of Canada's Second Report to the United Nations on the International Convention on the Rights of the Child (ICRC).

Eric Lowther moved,--That the Heritage Committee have hearings on the preparation of Canada's second report to the United Nations on the International Convention on the Rights of the Child (ICRC) before the House rises."

After debate, the question was put on the motion and resulted in the following division:
