Pursuant to order made Monday, January 25, 2021, the House proceeded to the taking of the deferred recorded division on the motion of Mr. Bergeron (Montarville), seconded by Mr. Ste-Marie (Joliette), — That, given that the pandemic and the pressure it is putting on public finances has created the urgent need to close the loopholes being taken advantage of by some taxpayers through the use of tax havens, in the opinion of the House, the government should: (a) amend the Income Tax Act and the Income Tax Regulations to ensure that income that Canadian corporations repatriate from their subsidiaries in tax havens ceases to be exempt from tax in Canada; (b) review the concept of permanent establishment so that income reported by shell companies created abroad by Canadian taxpayers for tax purposes is taxed in Canada; (c) require banks and other federally regulated financial institutions to disclose, in their annual reports, a list of their foreign subsidiaries and the amount of tax they would have been subject to had their income been reported in Canada; (d) review the tax regime applicable to digital multinationals, whose operations do not depend on having a physical presence, to tax them based on where they conduct business rather than where they reside; (e) work toward establishing a global registry of actual beneficiaries of shell companies to more effectively combat tax evasion; and (f) use the global financial crisis caused by the pandemic to launch a strong offensive at the Organisation for Economic Co-operation and Development against tax havens with the aim of eradicating them. Ste-Marie (Joliette), — Que, étant donné que la pandémie et la pression qu’elle exerce sur les finances publiques créent l’urgence de mettre fin aux échappatoires dont certains contribuables se prévalent en utilisant les paradis fiscaux, de l’avis de la Chambre, le gouvernement devrait : a) modifier la Loi de l’impôt sur le revenu et le Règlement de l’impôt sur le revenu pour que les revenus que les sociétés canadiennes rapatrient de leurs filiales dans les paradis fiscaux cessent d’être exempts d’impôt au Canada; b) revoir la notion d’établissement stable pour que les revenus comptabilisés dans des coquilles vides que des contribuables canadiens ont créées à l’étranger pour fins fiscales soient imposés au Canada; c) forcer les banques et les autres institutions financières de compétence fédérale à divulguer, dans leurs rapports annuels, la liste de leurs filiales à l’étranger et le montant d’impôt auxquelles elles auraient été assujetties si leurs revenus avaient été comptabilisés au Canada; d) revoir le régime fiscal applicable aux multinationales du numérique, dont les affaires ne dépendent pas d’une présence physique, pour les imposer dorénavant selon le lieu où elles mènent des activités plutôt que selon leur lieu de résidence; e) travailler à l’établissement d’un registre mondial des bénéficiaires réels de sociétés-écrans pour lutter plus efficacement contre l’évasion fiscale; f) profiter de la crise des finances publiques, engendrée à l’échelle mondiale par la pandémie, pour lancer auprès de l’Organisation de coopération et de développement économiques une offensive vigoureuse contre les paradis fiscaux, dont l'objectif est de les éradiquer.
